1. SCOPE OF APPLICATION
These General Terms and Conditions (GTC) apply to all orders and contractual relationships concluded through the online shop tiredcouture.com between E-Commerce Hegner, owner Remo Hegner, and the respective customers.
The offer is directed at both private customers and businesses.
By placing an order, the customer accepts these GTC.
2. PRODUCTS AND OFFERS
Clothing products are offered through tiredcouture.com.
The presentation of products in the online shop generally constitutes an invitation to place an order. Product images, colours and representations may differ slightly from the actual product delivered due to screen settings, technical circumstances or production-related variations.
E-Commerce Hegner reserves the right to change offers, products, prices and product information at any time.
3. CONCLUSION OF CONTRACT
The customer may select the desired products in the online shop and place an order.
The purchase contract is concluded once the customer completes the ordering process and payment has been successfully processed, provided that E-Commerce Hegner does not reject or cancel the order for a legitimate reason.
After completing the order, the customer will automatically receive an order confirmation by email.
4. PRICES AND VAT
All prices stated in the online shop are in Swiss francs (CHF) and include the applicable Swiss statutory value-added tax (VAT).
Additional shipping costs are displayed during the ordering process.
In the event of obvious pricing, display or technical errors, E-Commerce Hegner reserves the right to cancel an order following an individual review. Any payments already made will be refunded in such cases.
5. PAYMENT TERMS
Depending on availability, the following payment methods may be offered:
- Credit card
- Klarna
- TWINT
- Apple Pay
- Google Pay
The available payment methods may be changed or restricted at any time.
Orders will generally only be processed after successful payment.
6. ORDERS AND CANCELLATIONS
Once an order has been successfully completed and paid for, a subsequent cancellation is generally not guaranteed.
A cancellation after payment may be approved or rejected by E-Commerce Hegner on a case-by-case basis.
There is no entitlement to cancellation unless mandatory statutory provisions provide otherwise.
7. SHIPPING AND DELIVERY
Shipping is generally carried out via Swiss Post.
For deliveries within Switzerland, the standard shipping fee is CHF 7.-
For orders with a value of CHF 150 or more, shipping within Switzerland is generally free of charge.
The standard delivery time within Switzerland is approximately 1–3 business days.
The stated delivery times are estimates and may be delayed, particularly due to circumstances beyond the reasonable control of E-Commerce Hegner.
For international deliveries, additional costs may arise depending on the destination country, including customs duties, import taxes or other fees.
8. PRE-ORDER PRODUCTS
Products explicitly marked as “PRE-ORDER” in the online shop are generally only produced after the order has been placed.
Production and delivery may take up to approximately 1.5 months.
The information and estimated delivery times stated for the respective product must be observed.
PRE-ORDER orders generally cannot be cancelled, unless mandatory statutory provisions provide otherwise.
If PRE-ORDER products and regularly available products are included in the same order, they will generally be shipped together once the PRE-ORDER products become available.
9. UNAVAILABILITY
If an ordered product is unexpectedly unavailable, E-Commerce Hegner will review the respective case individually.
Depending on the circumstances, E-Commerce Hegner may offer an alternative solution, cancel the order in whole or in part, or refund the corresponding purchase price.
10. NO VOLUNTARY RIGHT OF RETURN OR EXCHANGE
E-Commerce Hegner generally does not grant a voluntary right of return or exchange for properly delivered goods.
There is no voluntary entitlement to return or exchange goods if the customer:
- Ordered the wrong size.
- Ordered the wrong colour.
- Ordered the wrong item.
- Changes their mind after the purchase.
Mandatory statutory rights of the customer remain unaffected.
11. DEFECTIVE OR FAULTY GOODS
The customer is required to inspect the goods received as soon as reasonably possible after delivery.
If a defect is discovered, it should be reported by email to info@tiredcouture.com within 7 days of receipt of the goods.
E-Commerce Hegner may request appropriate evidence, in particular photos or videos of the identified defect.
In the event of a justified complaint, an appropriate solution will be determined depending on the nature and extent of the defect. This may include a replacement delivery or a refund.
The customer’s statutory warranty rights remain unaffected and are not excluded by the aforementioned reporting period to the extent that mandatory law provides otherwise.
12. TRANSPORT DAMAGE AND LOSS
In the event that a shipment is damaged or lost during transport, the respective case will be reviewed individually.
Customers are requested to report any visible transport damage as soon as possible and to provide available evidence, such as photos of the damaged packaging or goods.
E-Commerce Hegner may cooperate with the relevant shipping provider to clarify the matter.
13. VOUCHERS AND DISCOUNT CODES
Vouchers and discount codes are subject to the conditions communicated at the time of issuance or as part of the respective promotion.
They may be subject to conditions regarding validity periods, minimum order values, product restrictions and combinability with other offers.
The conditions stated for the respective voucher or discount code shall apply.
14. RETENTION OF TITLE
The delivered goods remain the property of E-Commerce Hegner until the purchase price has been paid in full, to the extent that retention of title is permitted and required under applicable law.
15. LIABILITY
E-Commerce Hegner shall be liable in accordance with applicable statutory provisions.
Liability for damages caused by circumstances beyond the reasonable control of E-Commerce Hegner, including force majeure, significant disruptions to transport or communication systems, or other unforeseeable events, shall be governed by mandatory applicable statutory provisions.
Nothing in these GTC excludes liability to the extent that such exclusion is prohibited by law.
16. INTELLECTUAL PROPERTY
All content of the online shop, including texts, product descriptions, images, graphics, logos, designs and other content, is, unless otherwise stated, the property of E-Commerce Hegner or is used with appropriate authorization.
The use, reproduction or distribution of such content without prior consent is prohibited unless permitted by law.
17. DATA PROTECTION
The processing of personal data is carried out in accordance with the privacy policy published on tiredcouture.com.
The privacy policy constitutes separate information regarding the processing of personal data and does not form part of these GTC, unless otherwise required by law.
18. APPLICABLE LAW
The contractual relationships between E-Commerce Hegner and its customers are generally governed by Swiss law.
Mandatory statutory provisions, in particular those that may apply in favour of consumers at their place of residence, remain unaffected.
19. PLACE OF JURISDICTION
The legally applicable place of jurisdiction shall apply to disputes.
To the extent permitted by law and provided that no mandatory jurisdiction applies, the place of jurisdiction shall be at the registered office of E-Commerce Hegner in Switzerland.
20. AMENDMENTS TO THE GTC
E-Commerce Hegner reserves the right to amend these GTC at any time.
For orders that have already been concluded, the GTC applicable at the time the contract was concluded shall generally apply, unless otherwise required by law.
21. SEVERABILITY CLAUSE
If any provision of these GTC is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
To the extent legally permissible, the invalid or unenforceable provision shall be replaced by a provision that comes as close as possible to the economic purpose of the original provision.
